Amendments to the provisions of the Migration Code of the Republic of Azerbaijan on the entry, registration and entry ban of foreigners into the country have been amended.
Changes are in three main directions:
1. The period of stay without registration persons arriving in the territory of Azerbaijan
2. A ban on the entry of foreigners to the country
3. Determination of penalty for non-payment of administrative fine
According to the first amendment, if a foreigner or stateless person had to be registered in the territory of the Republic of Azerbaijan if they stayed here for more than 10 days, this period has been increased to 15 days. It means that, foreigners can stay without registration on the territory of Azerbaijan within 15 days.
According to the second amendment, the ban on a person's entry into the country has been simplified. Thus, before the changes were made, the person was brought to administrative responsibility for the violation of the rules of staying and living in the Republic of Azerbaijan, the entry of a person into the country was banned for up to five years. In that case the person could not enter to the country even if he/she paid the fine. But now if a foreigner or stateless person pays his/her fine, the ban on entering the country is immediately taken.
The content of the third amendment is the determination of penalty for non-payment of administrative fines. Thus, if the administrative fine is not paid within 30 days from the date when the fine came into the force, a penalty will be charged for the period of non-payment. The sum of the penalty is 1 percent of the amount of the fine for each day the administrative fine is not paid. It should be noted that the penalty is applied for 2 months after 30 days of non-payment of the fine. That is, the calculation of the penalty is stopped after 90 days maximum from the date of the entry into force of the administrative fine.
In general, the amendments are aimed at simplifying migration legislation and improving entry, staying and exit issues of foreigners to the Republic of Azerbaijan.
