New Employment Rules in Azerbaijan

According to the rule, The State Employment Service under the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan controls compliance with the requirements of normative legal acts in the field of employment by individuals and legal entities, including the branches and representative of foreign legal entities.

Control in the field of employment is exercised with the participation of trade unions.

Control in the field of employment is carried out in the form of ordinary or extraordinary inspections and monitoring of information in the field of employment.

Ordinary and extraordinary inspections are conducted in compliance with the law on “Regulation of inspections in entrepreneurship and protection of entrepreneurs` interests.”

Monitoring in the field of employment consists of collecting and obtaining information and taking measures on results of monitoring. Infringements discovered in the process of monitoring are presented to the appropriate bodies for the application of relevant measures.

Control in the field of employment is carried out in the following areas:

  • Provision of information about employed persons in the register of employed persons;
  • On the basis of service order, recruitment of persons with special needs for social protection and having difficulty in getting a job in the quota defined for them by employers;
  • Inclusion of information about legal entities involved in the employment of unemployed persons in the Republic of Azerbaijan, as well as employment of citizens of the Republic of Azerbaijan who is living abroad;
  • Provision of information on the number of employed persons and persons applying for employment by legal entities engaged in the employment of unemployed persons;
  • Provision to of the decision on retention of vacant positions within 5 (five) working days from the date of submission of the Service by the employer;
  •  Provision of information about job creation or dismissal to the “Centralized Electronic Information System” by employers no later than 5 (five) working days from the date of job creation or dismissal and etc.

It is worth to note that, The Code of Administrative Offenses of the Republic of Azerbaijan provides penalties from 300 to 1,000 AZN for the violation of employment legislation.
