Energy Efficiency Penalties Adopted

By the Law of the Republic of Azerbaijan dated November 5, 2022 "On Amendments to the Code of Administrative Offenses of the Republic of Azerbaijan", new administrative offenses in the field of effective use of energy resources and energy effectiveness have been determined.

According to the Law of the Republic of Azerbaijan "On the Effective Use of Energy Resources and Energy Efficiency", dated July 22, 2022, obligations in the field of effective use of energy resources and energy efficiency have been determined. According to the current changes, violation of the following requirements of the Law of the Republic of Azerbaijan "On Efficient Use of Energy Resources and Energy Efficiency" creates administrative responsibility according to Article 279 of the Code of Administrative Offenses:

1. Requirements related to conducting an energy audit provided for in Article 6 of the Law of the Republic of Azerbaijan "On effective use of energy resources and energy efficiency".

According to Article 6.3 of the Law of the Republic of Azerbaijan "On the Effective Use of Energy Resources and Energy Efficiency", it is mandatory to conduct an energy audit in business entities and non-residential buildings that meet the following criteria, regardless of the organizational and ownership form:

- business entities whose annual energy consumption exceeds 1000 tons of oil equivalent;

- non-residential buildings with a construction area of at least 10,000 square meters or an annual energy consumption of more than 250 tons of oil equivalent.

2. Failure to appoint an energy administrator (manager) in accordance with Article 8 of the Law of the Republic of Azerbaijan "On the effective use of energy resources and energy efficiency";

According to Article 8.1 of the Law of the Republic of Azerbaijan "On the Effective Use of Energy Resources and Energy Efficiency", an energy administrator (manager) is appointed by the heads of economic entities and owners (managers) of non-residential buildings, who is responsible for the efficient use of energy:

- in economic subjects whose annual energy consumption exceeds 1,000 tons of oil equivalent;

- in non-residential buildings with a construction area of at least 10,000 square meters or an annual energy consumption of more than 250 tons of oil equivalent.

3. Consideration of the results of the assessment of energy efficiency potential, non-fulfillment of obligations for the efficient use of energy resources determined for energy producers in accordance with Article 13 of the Law of the Republic of Azerbaijan "On the effective use of energy resources and energy efficiency".

For the commission of administrative offenses specified in Article 279 of the Code of Administrative Offenses, natural persons shall be fined in the amount of two hundred to four hundred manats, officials in the amount of one thousand to five hundred manats, and legal entities in the amount of two thousand five hundred to three thousand manats.
