On 26 November 2019, the Law of the Republic of Azerbaijan “On Technical Regulation” (hereinafter “the Law”) was adopted.
The law regulates the technical regulation of goods, their related processes and production methods, the requirements for technical standards, and the assessment of compliance with these requirements, as well as the general requirements for entities. According to the law, technical regulation is setting, adopting and implementing of mandatory requirements on goods, their related processes and production methods, as well as the legal regulation of compliance assessment, and technical standards are technical legal acts which specify mandatory requirements on goods, their related processes and production methods.
In order to implement the law, the Cabinet of Ministers of Azerbaijan Republic will adopt technical standards regarding technical regulation within 5 years after the Law comes into force. Mandatory requirements of technical standards will be limited to ensuring the safety of goods, their related processes and production methods.
A technical standard comes into force six months after its adoption, which during this time, local and foreign businesses can have the opportunity to adapt to the requirements of the relevant technical standards. Compliance of entities with technical regulations will be verified. A certificate of conformity will be issued to verify compliance for high-risk goods, and a declaration of conformity will be compiled for medium and low-risk goods.
The law will come into force on 26 May 2019.
